Continuing Criminal Enterprise and RICO Cases

Continuing criminal enterprise (CCE) charges (21 U.S.C. § 848) and violations of the federal Racketeer Influenced Corrupt Organizations Act (18 U.S.C. § 1961) are similar to drug conspiracy charges in that they are federal crimes which involve more than one person.

They differ from drug conspiracy in the sense that while a drug conspiracy charge can be a stand-alone offense, CCE and RICO cases hinge on multiple offenses linked to a larger criminal objective (gang activity, for example). These federal statutes are overly broad and ambiguous. They allow prosecutors to turn even a “low-level” offense into 20 years in federal prison.
