When a Gun Charge Isn't Just a Gun Charge…
A gun charge should never be taken lightly.
For example, a person convicted of using a gun in furtherance of a violent crime may be subject to a mandatory sentence of imprisonment. For another example, say someone has a lawfully owned and registered firearm on or near their person at the time of a drug trafficking arrest. That person may face a lengthy mandatory minimum sentence if convicted of the drug crime too.
In addition, a person convicted of a drug crime and also convicted of a gun crime in furtherance of that must serve consecutive sentences. The manner in which the weapon was used also impacts the length of the sentence.
Federal law also prohibits a person from possessing a firearm if he or she has been convicted of a crime punishable by more than one year in jail. This “felon-in-possession” law applies even if the crime is called a “misdemeanor” under state law.
For these reasons, it is critical to hire an attorney who is familiar with the federal laws concerning firearms. As a lawyer, Mark S. Greenberg has nearly 30 years of trial experience and resources to draw from and has handled various federal criminal offenses involving firearms, including:
- Use of a firearm in furtherance of a drug trafficking crime
- Use of a firearm in furtherance of a crime of violence
- Possession of illegal or prohibited weapons
- Unlawful sale or purchase of firearms
- Felon-in-possession violations
- Possession of explosive devices or body armor
- Bank robbery
- Hobbs Act
