Defense on Charges of Illegal Gun Purchase
Pennsylvania, New Jersey and Delaware
There are several ways people run into trouble with federal and state gun laws:
- If you buy a gun and then sell it illegally or give it to someone who is not allowed to own a gun because of a prior criminal charge
- If you provide a gun seller with false information when obtaining a weapon
- If you own an illegal firearm (such as an automatic weapon) or body armor
Gun dealers and employees at gun shops run afoul of gun laws when they sell to a person they know or should know is not the bona fide purchaser. Law enforcement sometimes sets up sting operations where an undercover officer attempts to buy a gun but drops hints or outright says that the information he is providing is incorrect. If the dealer continues with the sale, he is arrested. In this way the ATF has put a number of dealers out of business.

Sale to a straw purchaser (a third party purchaser) of a firearm is a state and federal offense. You may be charged at the state level. You may also face federal charges, especially in Philadelphia. Your defense against weapons charges hinges on whether the police can prove you were aware that the purchaser was a straw purchaser.
If you were the purchaser who gave a weapon to someone who later committed a crime, law enforcement will use the national firearm registry to determine where gun was purchased. They will then go to the gun seller to review paperwork on the purchase. While you may not be charged for the crime, you can face charges for making a straw purchase.
As a defense lawyer, Mr. Greenberg has a track record of successfully defending people against charges of illegal gun purchase. While a dismissal or acquittal is always the goal, if a conviction is likely, Mr. Greenberg will work to obtain the most favorable outcome possible given the facts of your case.
